Orders

When an order is placed with Gems Pets, it is considered an offer to purchase a specific product(s) for the stated price on the Website and in accordance with these Terms. Gems Pets reserves the right to reject the offer for any reason, including pricing or product description errors, purchasing quantities exceeding retail norms, and product unavailability. In these cases, Gems Pets may contact the customer to discuss alternative arrangements. Prices and product availability are subject to change without notice. Gems Pets is not responsible for stock shortages or sold-out items caused by third-party suppliers or manufacturers. If such an event occurs, Gems Pets may contact the customer to provide alternatives or offer a refund or store credit. Gems Pets also reserves the right to limit purchases to normal retail quantities. During our Black Friday promotions, in case a product is out of stock, customers have the option to receive a refund or delay the payment hold until the product is restocked and delivered to their address (payment will be held for a maximum of 30 days; otherwise, a refund will be issued).

All material published or displayed on the Website, including designs, logos, graphics, images, icons, photographs, typefaces, software, data, information, pictures, and other materials (collectively, “Content”), is the sole property of the Owner, including all third-party and user-generated content. If a Product is listed at an incorrect price due to a typographical error or pricing information received from our suppliers, Gems Pets reserves the right to refuse or cancel any orders placed for Products listed at the incorrect price. Such occurrences may warrant a refund or store credit and will be assessed on an ad hoc basis. If there is any inconsistency between the prices shown in Gems Pets’ catalogues, emails, or other promotional material and the prices shown on the Website due to human or typographical error, Gems Pets reserves the right to nominate which price the Product will be sold for and will not be held liable or responsible in any way.

Consumer Guarantees – Your Right to Refund, Replacement or Credit

Cypriot Consumer Law (CCL) is the national law for fair trading and consumer protection. Nothing in these terms excludes, restricts, or modifies any right, remedy, or consumer guarantee available to you under the CCL.

Under the CCL, you are entitled to a refund, replacement, or credit from Gems Pets when a product fails to meet one of the automatic consumer guarantees provided under the CCL. These guarantees include that:

• The product is faulty or of unacceptable quality;
• The product does not match the product description; and
• The product is unfit for the intended purpose (does not do what it is meant to);

The consumer guarantees will not apply where you have:

• caused the product to become damaged (such as using the product in a way that it is not intended to be used);
• have mistreated or abused the product (intentionally or unintentionally);
• received what you asked for but changed your mind, found it cheaper elsewhere or decided you do not like the product; or
• knew of or were made aware of the faults before you bought the product.

Gems Pets complies with Cypriot Consumer Law. If you receive a damaged or faulty product, or the product does not match its description or does not perform as promised, you may be entitled to a refund, replacement, or credit. However, we cannot offer refunds for products that have been damaged due to misuse or for products that you have simply changed your mind about. Please keep your proof of purchase.

Limitation of Liability

To the extent permitted by law, Gems Pets’ liability for any breach of any term, condition, or warranty implied by any Act of Parliament is limited to the cost of either replacing the product or having it repaired.

Indemnity

You are responsible for your actions while using the Gems Pets website. If you breach these terms and conditions or any laws or rights of a third party, you agree to indemnify and hold us and our related entities, affiliates, and our and their respective officers, agents, and employees harmless from and against any and all claims, demands, proceedings, losses, and damages (actual, special, and consequential) of every kind and nature, known and unknown, including reasonable legal fees.

Coupons and Discount Codes

Gems Pets may issue coupons or discount codes from time to time for use on our website. Discount codes cannot be applied to previously placed orders, cannot be used in conjunction with other offers unless otherwise specified, are not transferable or redeemable for cash or credit, and must be entered prior to completing your order. We reserve the right to modify, cancel, or restrict the use of discount codes at any time for whatever reason and exclude certain products from discount codes.

Delivery

While we try our best to ensure prompt and timely delivery of our products, shipping and other factors outside of our control may result in delays. Gems Pets does not accept any liability for loss or damage suffered by anyone as a result of any such delays, and we shall not be liable for any inaccuracy of information provided in relation to the date and time of delivery. We reserve the right not to ship to remote or rural locations. 

As part of our commitment to convenience, all our deliveries are door-to-door. Additionally, during checkout, you can specify your preferred delivery day and time. Feel free to leave a note to let us know when you’ll be available to receive your order. For our frozen food items, we employ special polyester boxes to ensure they remain frozen during delivery. In Paphos, orders will be delivered within 15-30 minutes of their pickup time, and in other cities, delivery will occur within 2-3 hours from the moment they are picked up by the courier.

During the period of the Black Friday Promotions, delivery times may extend up to 7 days.

Severability

If any portion of these terms and conditions is deemed to be invalid, illegal, or unenforceable, that will not affect or impair the validity, legality, or enforceability of the remaining terms.

Capacity

You must be over the age of 18 years and/or able to enter into a legally binding contract to use the Gems Pets website.

Law

These terms and conditions and your use of the Gems Pets website shall be governed by the laws in existence in Cyprus. Any claim related to gemspets.com and its constituents, and/or services provided by Gems Pets shall be governed by the laws of Cyprus, and you agree to submit to having the matter dealt with in a court within Paphos, Cyprus.
